Introduction
These Terms and Conditions (“Agreement”) are made between you (“Guest,” “You,” or “Your”) and Rest and Refresh a brand of AMZS Properties LTD, (“Provider,” “We,” “Us,” or “Our”) in relation to your booking(s) and stay at any of our serviced accommodation properties. By making a reservation and/or staying at the Property(s), you agree to comply with and be bound by the following Terms and Conditions.
1. Reservation and Booking
1.1 Booking Confirmation: A reservation is considered confirmed only after the required deposit or full payment is made and a confirmation is received from the Provider.
1.2 Booking Details: You must ensure that all details provided during the booking process, including the names of all guests, dates of stay, and payment details, are accurate.
1.3 Cancellation Policy:
- For cancellations made 30 days or more before check-in, a full refund will be issued.
- For cancellations made within 30 days of check-in, 5% of the booking amount will be charged.
- For no-shows or cancellations after check-in, no refund will be provided.
1.4 Modification of Booking: Any requests to modify an existing booking, including changes to check-in/check-out dates or the number of guests, must be submitted in writing to the Provider. Modifications are subject to availability and additional charges may apply.
2. Payment
2.1 Payment Terms: The total cost of your stay must be paid in full prior to check-in unless otherwise agreed with the Provider. Payments can be made via bank transfer. Payment is acceptance of all the Terms and Conditions.
2.2 Security Deposit: A refundable security deposit of [insert amount] may be required at check-in to cover any potential damages, breakages, or excessive cleaning costs. The deposit will be returned to you upon checkout, less any deductions for damages or additional costs incurred.
3. Check-in and Check-out
3.1 Check-in Time: Check-in is available from 14:00 on the agreed date of arrival. Early check-ins may be available upon request but are subject to prior approval and availability.
3.2 Check-out Time: Check-out must be completed by 11:00 on the agreed date of departure. Late check-out may be available upon request but will be subject to additional charges and availability.
3.3 Late Check-out: If you fail to check out on time, additional charges may apply for each hour or part of an hour after the agreed check-out time.
4. Use of Accommodation
4.1 Guest Numbers: The Property is for the use of the number of guests specified in the booking. Any additional guests may incur additional charges and must be approved by the Provider in advance.
4.2 Property Usage: The Property is to be used for lawful purposes only. You agree to comply with all local laws, regulations, and house rules. The accommodation is not to be used for parties, events, or commercial purposes without prior written consent.
4.3 No Smoking: Smoking is not permitted inside the Property. Smoking is only allowed in designated outdoor areas, if applicable. Failure to adhere to the no-smoking policy may result in a cleaning fee and/or forfeiture of your security deposit.
4.4 Pets: Pets are not permitted unless specifically stated in the booking confirmation or prior written approval is obtained. Any unauthorized pets found on the Property may result in additional cleaning charges and/or eviction from the Property.
4.5 Damage or Loss: You are responsible for any damage to the Property or its contents caused during your stay. In the event of damage or loss, you will be charged for repairs or replacement. The Provider reserves the right to deduct the cost from the security deposit or charge your payment method directly.
5. Responsibilities of the Guest
5.1 Guest Conduct: You and all accompanying guests must respect the Property, its furnishings, and neighbors. You must not cause a nuisance, disturbance, or engage in any unlawful behavior.
5.2 Cleaning: You agree to leave the Property in a reasonably clean and tidy condition upon departure. If excessive cleaning is required, additional charges may apply.
5.3 Loss of Keys or Access Cards: If keys, access cards, or other items issued to you are lost, you will be charged for their replacement.
5.4 Maintenance and Repairs: If any maintenance issues arise during your stay, please notify the Provider immediately. The Provider will make reasonable efforts to address any problems as quickly as possible. However, no compensation will be provided for any inconvenience caused by maintenance work or repairs.
6. Provider’s Responsibilities
6.1 Accommodation Quality: The Provider will ensure the Property is fit for the purpose of short-term accommodation and will be clean and properly maintained at the time of check-in.
6.2 Force Majeure: The Provider is not responsible for any failure to provide the Property or any part of the accommodation services if such failure is due to circumstances beyond their reasonable control (e.g., natural disasters, strikes, pandemics, etc.).
6.3 Refunds: If the Property is deemed unsuitable for occupancy due to issues that are the fault of the Provider, the Provider will attempt to relocate you to a comparable property or offer a partial or full refund, depending on the situation.
7. Privacy and Data Protection
7.1 Privacy Policy: The Provider collects personal information necessary for the completion of your booking and the provision of accommodation services. This information will be processed in accordance with the Provider’s Privacy Policy.
7.2 Third-Party Services: The Provider may share your information with third-party service providers (e.g., housekeeping, maintenance, or payment processors) in connection with your stay. These third parties are required to handle your data in compliance with applicable privacy laws.
8. Liability
8.1 Limitation of Liability: The Provider will not be liable for any loss, damage, or injury suffered by you or your guests during your stay, except where such loss or damage is caused by the negligence or willful misconduct of the Provider.
8.2 Indemnity: You agree to indemnify and hold the Provider harmless from any claims, damages, or losses arising from your use of the Property, including but not limited to injuries, property damage, or breaches of these Terms and Conditions.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of [insert jurisdiction], and any disputes will be subject to the exclusive jurisdiction of the courts in [insert location].
10. Amendments
